1. Ownership and Agreement to Terms
This website is owned and operated by Jen Bushman LLC. These Terms set forth the conditions under which you may use our website and the services offered by us. By accessing or using this website, you confirm that you have read, understand, and agree to be bound by these Terms.

2. Eligibility
To use our website and receive goods or services, you must have the legal authority, right, and freedom to enter into these Terms as a binding agreement. You may not use this website or receive services if doing so is prohibited in your country or under any law or regulation that applies to you.

3. Changes to Services and Availability
We may, without prior notice, change the services, stop providing features, or set limits on the services. We may permanently or temporarily terminate or suspend access to the services without notice or liability for any reason, or for no reason.

4. Purchases and Contract Formation
When purchasing an item, you agree that
i you are responsible for reading the full listing before purchasing
ii you enter a legally binding contract to purchase when you commit to buy and complete check out and payment.

5. Pricing
Prices for products and services are clearly listed on the website. We reserve the right to change prices at any time and to correct pricing errors that may occur.

6. Readings and Service Time
When purchasing a reading, you agree that you are paying for the time of the reader and not for any particular outcome or the quality of a reading.
ALL SALES ARE FINAL.

7. Crystal and Rock Shop Sales Policy
All purchases from our Crystal and Rock Shop are prepared with great care for shipment. Items are one of a kind and cannot be replaced. Rocks, stones, and crystals are formed by nature and may include natural cracks, crevices, fractures, color variations, and in some cases slight shedding during shipping.
We do not offer refunds, returns, or exchanges.
ALL SALES ARE FINAL.

8. Shipping Damage and Insurance
Insurance is included with shipping. If an item arrives with significant damage, it is your responsibility to pursue a claim with the carrier.
If you discover a broken item upon opening
• Stop opening packages when you realize an item is broken
• Return to the Post Office with all contents of the box, all packaging, the packing slip, and the invoice
• File a claim with the carrier
• Notify Jen at jen@jenbushman.com

If the box appears severely damaged on delivery, we recommend opening it at the Post Office in front of a Postal Person to support any claim with the carrier.
If for any reason we grant an exception and authorize a refund, the refund will exclude both the original and return shipping costs.

9. Order Issues and Time to Report
If there are issues with your order, email jen@jenbushman.com within 3 days of the delivery date by replying to your order confirmation email.

10. Intellectual Property
The Service and all materials contained in or transferred through it, including software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and all related intellectual property rights, are the exclusive property of Jen Bushman LLC. Except as expressly provided in these Terms, no license is granted. You agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, share, give away, edit, or create derivative works from any such materials.

11. Termination
We may permanently or temporarily terminate or suspend your access to the Service without notice or liability for any reason, including if in our sole determination you violate these Terms or applicable law. You may discontinue use and request to cancel your account or any services at any time. For automatically renewed subscriptions to paid services, cancellation takes effect at the end of the period already paid.

12. Indemnification
You agree to indemnify and hold Jen Bushman LLC harmless from any demands, losses, liabilities, claims, or expenses including attorneys fees made by any third party due to or arising out of your use of the website or the services offered on the website.

13. Limitation of Liability
To the maximum extent permitted by law, Jen Bushman LLC is not liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation loss of profits, goodwill, use, data, or other intangible losses, arising from or relating to your use of or inability to use the Service.

14. Disclaimers
To the maximum extent permitted by law, Jen Bushman LLC assumes no liability or responsibility for
i errors, mistakes, or inaccuracies of content
ii personal injury or property damage resulting from access to or use of the Service
iii any unauthorized access to or use of our secure servers or any personal information stored therein.

15. Changes to These Terms
We may modify these Terms at our sole discretion. You should review this page periodically. If we make material changes, we will notify you. Your continued use of the website or services after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to any current or future version of the Terms, do not use or access the website or the Service.

You agree to receive occasional promotional messages and materials from us by mail, email, or other contact information you provide, including phone number for calls or text messages. You may opt out at any time by notifying us.

17. Governing Law and Venue
These Terms and any claims or disputes related to them or to the services are governed by the internal laws of New Mexico, USA, without regard to conflict of law principles. All claims and disputes shall be brought exclusively in a court of competent jurisdiction located in Albuquerque, New Mexico. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
